BACKGROUND AND PURPOSE 

Under current law, licensees and permitees are required to submit a
performance bond and a tax security bond.  Senate Bill 1235 authorizes the
Texas Alcoholic Beverage Commission to determine by rule if such bonds are
required. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that rulemaking
authority is expressly delegated to the Texas Alcoholic Beverage Commission
in SECTION 1 (Section 204.07, Alcoholic Beverage Code) of this bill. 

ANALYSIS

Senate Bill 1235 amends the Alcoholic Beverage Code to authorize the Texas
Alcoholic Beverage Commission (commission) to waive the requirement that  a
licensee or permitee furnish a bond if the commission by rule determines
the submission of the bond is no longer necessary.  

EFFECTIVE DATE

September 1, 2001.
