HBA-MSH S.B. 1396 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1396 By: Fraser State Affairs 5/17/2001 Engrossed BACKGROUND AND PURPOSE Current law requires state agencies to notify the Texas Workforce Commission (TWC) and the Equal Employment Opportunity (EEO) Office in the governor's office of all job vacancies occurring and filled in Travis County. The functions of the EEO office have been administratively transferred to TWC. When the transfer occurred, the law regarding notification of job vacancies was not amended to reflect the new arrangement. Senate Bill 1396 requires state agencies to notify only TWC of job vacancies and filings. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1396 amends the Government Code to remove the requirement for a state agency after a job vacancy occurs or is filled in Travis County by that state agency to complete and deliver to the Equal Employment Opportunity Office in the governor's office the appropriate information form prescribed by the Texas Workforce Commission and pertaining to a job vacancy or placement. EFFECTIVE DATE September 1, 2001.
