HBA-BSM S.B. 1433 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1433 By: Ogden Judicial Affairs 4/27/2001 Engrossed BACKGROUND AND PURPOSE Currently, the 361st District Court has criminal jurisdiction over both felony and misdemeanor cases, while the 85th and 272nd district courts have only felony criminal jurisdiction. The misdemeanor case loads may be alleviated if the 85th and 272nd district courts also had jurisdiction in this area. Senate Bill 1433 expands the jurisdiction of the 85th and 272nd district courts to include misdemeanor criminal jurisdiction. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1433 amends the Government Code to provide that the 85th, 272nd, and 361st district courts of Brazos County have concurrent jurisdiction with the statutory county courts of Brazos County in misdemeanor cases as well as jurisdiction prescribed by general law for district courts. EFFECTIVE DATE September 1, 2001.
