HBA-AMW S.B. 1453 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1453 By: Lucio Criminal Jurisprudence 5/15/2001 Engrossed BACKGROUND AND PURPOSE The 76th Legislature rescinded the eligibility of a defendant convicted of certain violent felonies to obtain bail pending an appeal. However, the legislation did not include the conviction of an offense involving injury to a child, elderly individual, or disabled individual. Senate Bill 1453 prohibits a defendant convicted of an offense involving injury to a child, elderly individual, or disabled individual from being released on bail pending appeal of the conviction. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency or institution. ANALYSIS Senate Bill 1453 amends the Code of Criminal Procedure to prohibit a person convicted of an offense involving injury to a child, elderly individual, or disabled individual from being released on bail pending appeal of the conviction. EFFECTIVE DATE September 1, 2001.
