HBA-SEP S.B. 1589 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1589 By: Moncrief Juvenile Justice & Family Issues 4/20/2001 Engrossed BACKGROUND AND PURPOSE Under current law, the Texas Juvenile Probation Commission (TJPC) is subject to the authority of the Health and Human Services Commission (HHSC). Health and human services agencies are regarded as Article II agencies in the legislative appropriations bill. However, TJPC's appropriation is contained in Article V with public safety agencies. HHSC provides in-depth analysis and study of trends, statistics, programs, and outcomes for all health and human service agencies except TJPC. TJPC's analysis is provided by the Criminal Justice Policy Council which provides for public safety agencies such as the Texas Department of Criminal Justice and the Texas Youth Commission. Senate Bill 1589 removes TJPC from the list of health and human services agencies. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1589 amends the Government and Health and Human Resources codes to remove the Texas Juvenile Probation Commission from the list of health and human services agencies subject to the authority of the Health and Human Services Commission and repeals provisions giving certain powers and duties to the commissioner of health and human services. EFFECTIVE DATE September 1, 2001.
