HBA-AMW S.B. 1771 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1771 By: Armbrister Natural Resources 5/10/2001 Engrossed BACKGROUND AND PURPOSE The Texas Constitution authorizes the creation of water control and improvement districts to supply and store water for use, operate sanitary wastewater systems, and provide irrigation, drainage, and water quality services. Because of the continuing growth of the extraterritorial jurisdiction of the City of Dripping Springs a water control and improvement district is needed to provide water, sewer, and drainage services to the area. Senate Bill 1771 creates the Hays County Water Control and Improvement District No. 3, subject to voter approval at a confirmation election. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1771 creates the Hays County Water Control and Improvement District No. 3 (district), subject to voter approval at a confirmation election. The bill sets forth the metes and bounds of the district (SECTION 1-3). The bill provides that the district is governed by a board of five directors and sets forth provisions regarding the election, qualifications, vacancy, and terms of the directors as well as the names of the temporary directors. The bill sets forth provisions regarding an election to confirm the establishment of the district (SECTIONS 7-10). The bill authorizes the district and the owners of the land within the district to separately or jointly enter into written contracts with any municipality whose extraterritorial jurisdiction (ETJ) is located wholly or partly in the district and sets forth provisions that specify the authorized purposes of these contracts (SECTION 12). The bill also authorizes the district, a municipality whose ETJ is wholly or partly within the district, and the county within which the district is located to enter into a written contract regarding the development regulations applicable to the land within the district (SECTION 14). EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
