HBA-JEK S.B. 1793 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1793 By: Sibley Insurance 5/8/2001 Engrossed BACKGROUND AND PURPOSE In 1991, the 72nd Legislature renamed the State Board of Insurance as the Texas Department of Insurance. Senate Bill 1793 reflects this change in the Government Code and provides that open meeting requirements do not apply to a meeting of the commissioner of insurance and the board of directors of certain guaranty associations regarding the solvency of a person. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1793 amends the Government Code to provide that open meeting requirements do not apply to a meeting regarding the solvency of a person that occurs between the commissioner of insurance (commissioner) or the commissioner's designee and the board of directors of a guaranty association established by the Texas Title Insurance Guaranty Act, the Texas Property and Casualty Insurance Guaranty Act, or the Life, Accident, Health, and Hospital Service Insurance Guaranty Association Act. EFFECTIVE DATE September 1, 2001.
