HBA-EDN S.B. 233 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 233 By: Harris Juvenile Justice & Family Issues 3/18/2001 Engrossed BACKGROUND AND PURPOSE Under current law, there is an inconsistency regarding the age bracket used in the definition of a child in certain cases of liability. Senate Bill 233 amends provisions pertaining to parental liability for the conduct of a child to include children who are at least 10, rather than 12, years of age. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 233 amends the Family Code to provide that a parent or other person who has the duty of control and reasonable discipline of a child is liable for any property damage proximately caused by the wilful and malicious conduct of a child who is at least 10, but is under 18 years of age. EFFECTIVE DATE September 1, 2001.
