HBA-KDB S.B. 386 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 386 By: Bivins Higher Education 4/27/2001 Engrossed BACKGROUND AND PURPOSE In 1995, the 74th Legislature recommended zero funding for the Amarillo campus of the Texas State Technical College (TSTC). Because of this lack of funding, TSTC has not administered any programs at the Amarillo campus. The TSTC--Marshall campus opened in 1992 as an extension of TSTC--Waco, and became the system's fourth independent college on September 1, 1999. However, the Marshall campus is not specifically entitled to receive a portion of the amount of funds allocated to TSTC. Senate Bill 386 removes the Amarillo campus from the enabling statute of the TSTC system and provides that the Marshall campus receive a portion of the amount allocated to TSTC. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 386 amends the Education Code to remove the provision that the Texas State Technical College System (system) includes a campus located in the city of Amarillo in Potter County. The bill provides that the Texas State Technical College--Marshall is one of the component campuses of the system that receives the amount allocated to eligible institutions. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
