HBA-MPM S.B. 403 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 403 By: Zaffirini Public Education 4/26/2001 Engrossed BACKGROUND AND PURPOSE Current state law does not permit military officers to serve on the school boards of military reservation school districts, which is inconsistent with federal policy. Senate Bill 403 authorizes the appointment of military officers, military retirees, and parents of children enrolled in a primary or secondary school on the military reservation to the board of trustees of a military reservation school district. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 403 amends the Education Code to authorize the State Board of Education to appoint military officers in addition to enlisted military personnel to the board of trustees for a military reservation school district. Additionally, the bill authorizes military retirees and parents whose children are enrolled in the primary or secondary school on the military reservation to be appointed to the board. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
