HBA-NRS S.B. 439 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 439 By: Madla Public Health 3/21/2001 Engrossed BACKGROUND AND PURPOSE Current law requires an organization or entity requesting a grant from the Texas Commission on Alcohol and Drug Abuse (TCADA) to provide matching funds equal to at least five percent of the total grant of state funds being requested from TCADA. It is not clear from the law exactly what the matching funds should include. Many organizations helping to meet the needs of less fortunate Texans do not have access to large amounts of cash, but do have access to in-kind contributions such as equipment and vehicles that could be used toward qualifying for state funds. Senate Bill 439 modifies law by providing that matching funds may be either cash or in-kind contributions. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 439 amends the Health and Safety Code to provide that an organization or other entity is not eligible for a grant of state funds from the Texas Commission on Alcohol and Drug Abuse (TCADA) unless the organization or entity provides matching funds, in either cash or in-kind contributions, equal to at least five percent of the total grant of state funds from TCADA. EFFECTIVE DATE September 1, 2001.
