HBA-TBM S.B. 949 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 949 By: Shapiro Public Education 5/18/2001 Engrossed BACKGROUND AND PURPOSE Under current law, open-enrollment charter schools are not subject to municipal zoning ordinances. Municipal zoning ordinances are in place to ensure that a school is not located in an area that may provide a hazard to student safety. Senate Bill 949 subjects open-enrollment charter schools to municipal zoning ordinances. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 949 amends the Education Code to provide that an open-enrollment charter school (school) is subject to municipal zoning ordinances governing public schools unless a campus of the school is located in whole or in part in a municipality with a population of 20,000 or less. EFFECTIVE DATE September 1, 2001.
