SCR 64, 64th R.S.
Granting permission to T. C. Bateson Construction Company, Ling-Alterman, Natkin/Todd-Ford, Fresno Structural and Hanger Fabricators, Incorporated, Redondo Manufacturing Company, Incoporated, A-1 Pierce Enterprises, and L. E. (Ed) Travis and Sons, Incorporated, and McDonough Brothers, Incorporated, be and the same are hereby granted permission to bring and maintain suit against the State of Texas, including The University of Texas System and its regents, in a district court of Travis County, Texas, or in such other court as may have jurisdiction under the general laws of the State of Texas, to recover judgment in such amount and for such other relief as may be determined by a court or jury; providing that the sole purpose of this resolution is to grant permission to the aforesaid parties to maintain suit against the State of Texas and any instrumentality thereof, and no admission of liability or obligation is intended to be evidenced by this resolution, and further, that the parties described above shall be required to prove all essential facts as in other similar cases, and either party may appeal from any judgement entered, in accordance with the rules and laws of civil procedure; providing that nothing in this resolution shall be construed as an admission of any fact or of any liability by or against the State of Texas or any of the parties named above, and all facts set out herein which are relied upon by the parties must be proved in court for any recovery to be made; providing that nothing contained in this resolution shall constitute a waiver of any defense available to the State of Texas other than the defense of sovereign immunity to suit.
