Granting W.D. Turner Construction, Inc., permission to sue the State of Texas within a period of two years after the effective date of this resolution in any court in Texas having jurisdiction; providing that service of citation and all other necessary processes may be had upon the Attorney General of the State of Texas, at Austin, Texas, and that the suit shall be tried under the same rules of law, liability, and evidence and in like manner as suits instituted against private corporations are tried; providing that nothing in this resolution shall be construed as an admission of liability or of any fact against the state and all facts set out herein or relied on by plaintiff to recover must be proved in court; providing that nothing contained in this resolution shall consitute a waiver of any defense available to the State of Texas other than the defense of sovereign immunity to be sued without legislative permission; providing that nothing in this resolution may be construed as a waiver of any defense of fact or law available to the State of Texas or to any of its employees, agents, departments, agencies, or political subdivisions, but every defense is specifically reserved.
