Granting permission to Maryland Casualty Company and Northern Insurance Company of New York to sue the State of Texas and the Texas Insurance Department, within a period of two years after the effective date of this resolution, in any court in Texas having jurisdiction, in order to determine what refund, if any, or other relief it is entitled to recover; providing that service of citation in all of the necessary processes may be had upon the Attorney General of the State of Texas, at Austin, Texas, and said suit shall be tried under the same rules of law, liability, and evidence and in like manner as suits instituted or tried against private corporations; providing that nothing in this resolution shall be construed as an admission of liability or of any fact against the state and all facts set out herein or relied upon by plaintiff to recover must be proved in court; providing that nothing contained in this resolution shall constitute a waiver of any defense available to the State of Texas other than the defense of sovereign immunity to be sued without legislative permission.
