Relating to misuse of a dairy container bearing a proprietary mark by clarifying and modernizing the definition of "dairy container," requiring the Texas Department of Health Resources to adopt rules and regulations to prevent deceptive trade practices and unauthorized private use of dairy containers, including but not limited to procedures for registration of proprietary marks, with appropriate fees and annual renewals; deposits; defining certain offenses and prescribing penalties; declaring certain uses of dairy containers to be unauthorized private use, fixing penalties for unauthorized private use, providing severability and declaring an emergency.
