SCR 42, 64th R.S.
Granting permission to the parties, as that term is hereinafter defined, to sue the State of Texas to establish any and all claims which they ahve or assert to lands within the three tracts of land hereinafter described; providing that the term "parties" means the following named persons, firms, or corporations, their respective heirs, personal representatives, successors, and assigns, together with any and all other persons, firms, or corporations who are which any court of competent jurisdiction may determine are necessary or proper parties to the litigation here authorized, whether such joinder is effected by intervention or joinder as involuntary plaintiffs or as defendants, and who as defendants would ahve a permissive or compulsory counterclaim or cross-claim which might be asserted against the State of Texas; providing that the tracts with regard to which suit may be brought, either separately or concurrently, are as follows; providing that the venue of the suit or suits be in any district court in any county in which any one of the tracts is located, and that in the event the suit is filed, service of citation and other required process be made on the attorney general and on the commissioner of the general land office; providing that nothing in this resolution shall be construed as an admission by the State of Texas, or any of its agents, employees, departments, agencies, or political subdivisions, of liability or of the truth of any allegations asserted by the claimant but the alleged cause of action must be proved under the laws of this state as in other civil cases; providing that nothing in this resolution shall be construed as a waiver of any defense of fact or law available to the State of Texas or any of its agents, employees, departments, agencies, or political subdivisions, but every defense is specifically reserved.
