John C. McCoy challenged the election of Henry J. Moffatt; 11/11/1863, the Committee on Privileges and Elections declared the seat vacant, and on 11/19/1863 the legislature sent the governor an act authorizing a special election. Murrah approved it 11/20/1863 but had already issued a proclamation on the subject November 18. A second proclamation of November 20 fixed an election for December 5 that was won by McCoy, probably sworn before the last day of the session, December 16. Journals after December 3rd are missing.
