1. Streamlining Water Permitting: Study and recommend changes that promote streamlining of water right permit issuance and the amendment process by the TCEQ for surface water, and that promote uniform and streamline permitting by groundwater conservation districts for groundwater. Evaluate more transparent process needs and proper valuation of water.
5. Regulatory Framework of Groundwater Conservation Districts and River Authorities: Study and make recommendations on the regulatory framework for managing groundwater in Texas to ensure that private property rights are being sufficiently protected. Study the role of river authorities and groundwater conservation districts including the state's oversight role of their operations and fees imposed.
6. Agricultural Fees: Review licensing, permitting, or registration requirements and fees imposed on the agriculture industry by licensing agencies within the committee's jurisdiction. Make recommendations for state licenses and fees that should be reduced, repealed or transitioned to private-sector enforcement.
7. Monitoring: Monitor the implementation of legislation addressed by the Senate Committee on Agriculture, Water & Rural Affairs during the 85th Legislature, Regular Session, including, but not limited to: • SB 1511 (prioritization in the regional water plan); • SB 1538 (Floodplain Management Account uses); • SB 864 (GCD application of state water); • HB 2004 (Texas economic development fund for TDA); and • HB 3433 (adoption of rules affecting rural communities. Make recommendations for any legislative improvements needed to improve, enhance, or complete implementation including regional water planning, flood planning, and groundwater production.)

Charges: This report should address the charges below.
1. Study infrastructure security and energy restoration post weather events. Identify ways state government entities can help utilities more effectively stage pre-hurricane mobilization crews for managing resources before an event.
2. Examine state mortgage requirements regarding the notification of homebuyers on their need for flood insurance in flood plains and flood pool areas and make recommendations on how to better inform consumers.
3. Examine local government regulations, including occupational licenses, as related to Hurricane Harvey and determine if any are a detriment to rebuilding efforts.
4. Examine and make recommendations on the need for changes to the Texas Constitution for home equity lenders to offer various forms of relief to Texas homeowners affected by natural disasters including, among others, the authority to enter into deferment agreements. This examination should include a study of home equity rules regarding negotiation, modification and refinancing and whether constitutionally established time periods can be waived in times of disasters.
5. Free Market Electricity: Examine the competitive nature of the Texas retail electric system and what government competitive intrusions in the free energy markets may have in distorting those markets. Review the impact of competitive versus noncompetitive retail electricity markets across the state in terms of price and reliability. Consider the projected impact of establishing competitive electric retail markets statewide.
6. Health Insurance Market Stability: Study the factors affecting health insurance markets in Texas, particularly the individual market, including federal and state law. Make recommendations that would result in increased stability in the markets and enhance value and affordability for individual consumers and businesses. Examine what steps the state needs to take to allow out-of-state health insurance sales. In developing its recommendations, the committee should consider the flexibility afforded to states by 1332 "state innovation" waivers, which allow states to modify or eliminate tax penalties associated with individual and employer coverage mandates; modify requirements for benefits and subsidies; and find alternative ways to provide benefit plan choices, determine eligibility for subsidies, and enroll consumers.
7. Licensing and Fees: Review licensing requirements and fees imposed on entities within the committee's jurisdiction. Make recommendations for state licenses and fees that should be reduced, repealed or transitioned to private-sector enforcement.
8. Social Media Access: Study access issues regarding digital assets of decedents. Study social media privacy laws and whether job applicants and students' privacy is jeopardized under current law.
9. Examine the 2018 electric reliability forecasts announced by ERCOT and review how expected diminished reserve markets will impact the rates of residential and business consumers. Monitor current mechanisms available to ERCOT to ensure grid reliability, identify trends in the wholesale electric market, and make recommendations to maintain grid reliability moving forward.
10. Monitoring Charge: Monitor the implementation of legislation addressed by the Senate Committee on Business and Commerce during the 85th Legislature, Regular Session, including: • The implementation of legislation to deregulate occupational licensing; • The settlement of out-of-network health benefit claims involving balance billing and patient's explanation of benefits statements; and • Make recommendations regarding any additional legislation needed to improve, enhance, and/ or complete implementation.

1. Evaluate the Texas Department of Criminal Justice response to Hurricane Harvey. Recommend any changes that could improve the operational stability of state criminal justice institutions following a natural disaster and changes that would allow for a more effective response.
2. Examine the use of social workers and peer support specialists in the Texas criminal justice system to assist individuals on probation, on parole, or who have been discharged, in order to reduce recidivism and improve outcomes. Identify best practices and make recommendations for legislative action.
3. Examine the current Texas criminal justice system policies and practices regarding 17- to 25- year-olds, specific to probation, parole, state jail confinement, and discharge from the Texas Department of Criminal Justice or county jail. Review any gaps in services that may be causing this population to recidivate. Make recommendations to improve the state's response to the needs of this population in order to lower revocation, re-arrest, and re-incarceration rates.
4. Examine treatment options, services, and programs available to women in institutional settings, on community supervision, on parole, and in community-based programs. Make recommendations for best strategies to address the needs of women in the Texas criminal justice system.
5. Review the Texas state jail system. Examine its original intent, sentencing guidelines, effectiveness, and recidivism rates. Make recommendations for changes in the state jail system. (Joint charge with the House Committee on Criminal Jurisprudence)
6. Study policies and protocols within the Texas Department of Criminal Justice to prevent the spread of infectious diseases. Examine when protocols are implemented and their efficacy in protecting the health and safety of inmates and state employees.
7. Review assessments used by the Board of Pardons and Paroles and parole panels to determine an inmate's risk of recidivism for purposes of granting parole and the use of GPS technology to monitor offenders.
8. Monitor Texas prison system heat-related litigation currently making its way through the courts. Monitor Prison Rape Elimination Act (PREA) compliance within Texas state and county criminal justice facilities.
9. Monitor the agencies and programs under the Committee’s jurisdiction and oversee the implementation of relevant legislation passed by the 85th Legislature.

2. Evaluate whether counties have the necessary ordinance-making and enforcement authority to deal with flood risk in unincorporated rural and suburban areas of Texas. Additionally, examine whether counties have adequate resources and authority to ensure that new development in unincorporated areas is not susceptible to flooding.
3. Study how counties identify defendants' and inmates' behavioral health needs and deferral opportunities to appropriate rehabilitative and transition services. Consider models for ensuring defendants and inmates with mental illness receive appropriate services upon release from the criminal justice system.
4. Review the population limitations found in Local Government Code Section 154.041 and Local Government Code Section 113.047. Determine if counties with a population below 190,000 could benefit from the population limitations being removed.
5. Monitor the agencies and programs under the Committee’s jurisdiction and oversee the implementation of relevant legislation passed by the 85th Legislature.

5. Examine the needs of homeless veterans in Texas. Examine obstacles veterans may face finding housing across the state. Recommend measures to bolster the state's efforts to address veteran homelessness in Texas.
6. Monitor the agencies and programs under the Committee’s jurisdiction and oversee the implementation of relevant legislation passed by the 85th Legislature. In conducting this oversight, review the implementation of S.B. 27 (85R) and the related Veterans Mental Health Program, as well as S.B. 578 (85R) and the development of the Veterans Suicide Prevention Action Plan.

4. Evaluate whether, in light of recent Texas Supreme Court rulings, the provisions of the Public Information Act are adequate to support transparency and accountability in government, particularly as it relates to government contracting and procurement.
5. Study how state agencies can share knowledge and practices, reduce duplicative data gathering, and conduct business in a more efficient manner through interagency data sharing. Review best practices to provide the public with more transparency and access to government information.
6. Monitor the agencies and programs under the Committee’s jurisdiction and oversee the implementation of relevant legislation passed by the 85th Legislature. In conducting this oversight, the committee will also specifically monitor the implementation of H.B. 8 (85R).

1. Review the state's response to Hurricane Harvey with a focus on public health efforts at the local and state level. The review should include an analysis of the state and local response related to vector control, immunization needs, utilization of health-related volunteers, adequacy of an emergency medical network, evacuation of vulnerable populations from state operated or regulated facilities, and coordination between all levels of government. Recommend any legislative changes necessary to improve public health response and coordination during and after a disaster.
2. Evaluate the impact of Hurricane Harvey on the capacity of out-of-home placements and care for youth involved with the juvenile justice and child welfare systems. Determine how the state can ensure support is available to provide appropriate care as close to home as possible as facilities and offices are rebuilt.
3. Child Welfare: Review the efficacy and quality of services offered to ensure family preservation while in the Family Based Social Services (FESS) stage of service at the Department of Family and Protective Services. Make recommendations to better track quality of services and link payments to providers of these services to outcomes for families and children. Analyze the Department of Family and Protective Services' progress in meeting statutory requirements related to timely visits to children involved in a reported case of abuse or neglect. Make recommendations to further improve the timeliness of these visits. Review services and supports provided to children in Permanent Managing Conservatorship of the state, and the level of preparedness given to youth aging out of state care. Examine the impact of recent legislation related to these populations, and make recommendations to ensure youth in care are ready for adulthood and to reduce the likelihood of intergenerational perpetuation of child maltreatment. Assess the effectiveness of public and private agency efforts to recruit and retain foster parents. Identify barriers to entry and obstacles that prevent interested families from continuing to provide foster care. Recommend solutions to increase foster recruitment and address non-renewals, especially in first-time foster parents.
4. Substance Abuse/Opioids: Review substance use prevention, intervention, and recovery programs operated or funded by the state and make recommendations to enhance services, outreach, and agency coordination. Examine the adequacy of substance use, services for pregnant and postpartum women enrolled in Medicaid or the Healthy Texas Women Program and recommend ways to improve substance use related health outcomes for these women and their newborns. Examine the impact of recent legislative efforts to curb overprescribing and doctor shopping via the prescription monitoring program and recommend ways to expand on current efforts.
5. Medicaid Managed Care Quality and Compliance: Review the Health and Human Services Commission's efforts to improve quality and efficiency in the Medicaid program, including pay-for-quality initiatives in Medicaid managed care. Compare alternative payment models and value-based payment arrangements with providers in Medicaid managed care, the Employees Retirement System, and the Teachers Retirement System, and identify areas for cross-collaboration and coordination among these entities. Evaluate the commission's efforts to ensure Medicaid managed care organizations' compliance with contractual obligations and the use of incentives and sanctions to enforce compliance. Assess the commission's progress in implementing competitive bidding practices for Medicaid managed care contracts and other initiatives to ensure the best value for taxpayer dollars used in Medicaid managed care contracts.
6. Health Care Cost Transparency: Study efforts by the Department of State Health Services and the Texas Department of Insurance to increase health care cost transparency, including a review of the Texas Health Care Information Collection (THCIC) system, and the Consumer Guide to Healthcare. Recommend ways to make provider and facility fees more accessible to consumers to improve health care cost transparency, increase quality of care, and create a more informed health care consumer base.
7. Monitoring Charge: Monitor the implementation of legislation addressed by the Senate Committee on Health and Human Services, 85th Legislature and make recommendations for any legislation needed to improve, enhance, and/or complete implementation, including but not limited to: • Initiatives to increase capacity and reduce waitlists in the mental health system, including the construction of state hospitals and new community grant programs; • Initiatives to better understand the causes of maternal mortality and morbidity, including the impact of legislation passed during the first special session of the 85th Legislature. Recommend ways to improve health outcomes for pregnant women and methods to better collect data related to maternal mortality and morbidity; • Initiatives intended to improve child safety, Child Protective Services workforce retention, and development of additional capacity in the foster care system. Make additional recommendations to ensure children with high levels of medical or mental health needs receive timely access to services in the least restrictive setting; • Efforts to transfer case management of foster children and families to Single Source Continuum Contractors (SSCCs). Monitor the progress of this transition and make recommendations to ensure the process provides continuity of services for children and families and ongoing community engagement; • Initiatives to strengthen oversight oflong-term care facilities to ensure safety and improve quality for residents and clients of these entities; and • Abortion complications and other reporting legislation that was passed by the 85th Legislatu re.

1. Study the impact of Hurricane Harvey and the response to the storm on individuals living in long-term care facilities, assisted living facilities, state supported living centers, licensed community group homes, and children in the foster care system. Identify and recommend necessary solutions to ensure appropriate disaster-related protocols are in place to keep vulnerable Texans protected. Also, identify any challenges state agencies experienced in responding to the storm or during recovery efforts.
2. Review the history and any future roll-out of Medicaid Managed Care in Texas. Determine the impact managed care has had on the quality and cost of care. In the review, determine: initiatives that managed care organizations (MCOs) have implemented to improve quality of care; whether access to care and network adequacy contractual requirements are sufficient; and whether MCOs have improved the coordination of care. Also determine provider and Medicaid participants’ satisfaction within STAR, STAR Health, Star Kids, and STAR+Plus managed care programs. In addition, review the Health and Human Services Commission's (HHSC) oversight of managed care organizations, and make recommendations for any needed improvement.
3. Examine the survey process for nursing facilities to determine any duplication of government regulations. Consider recommendations to reduce duplication while ensuring patient safety is preserved.
4. Review the availability of prevention and early intervention programs and determine their effectiveness in reducing maltreatment of children. In addition, review services available to children emancipating out of foster care, as well as services available to families post-adoption. Determine if current services are adequately providing for children's needs and meeting the objectives of the programs. While reviewing possible system improvements for children, follow the work of the Supreme Court of Texas Children's Commissions' Statewide Collaborative of Trauma-Informed Care to determine how trauma-informed care impacts outcomes for children.
5. Analyze the prevalence of children involved with Child Protective Services (CPS) who have a mental illness and/or a substance use disorder. In addition, analyze the prevalence of children involved with CPS due to their guardian's substance abuse or because of an untreated mental illness. Identify methods to strengthen CPS processes and services, including efforts for family preservation; increasing the number of appropriate placements designed for children with high needs; and ensuring Texas Medicaid is providing access to appropriate and effective behavioral health services. 6. Monitor the HHSC's implementation of Rider 219 in Article II of the General Appropriations Act related to prescription drug benefit administration in Medicaid. Analyze the role of pharmacy benefit managers in Texas Medicaid.

ETJ Limitations and Notice: Review the existing regulatory authority granted to home-rule municipalities within the extraterritorial jurisdiction (ETJ), including practices used by cities to expand ETJ boundaries, and whether proper notification is provided to property owners added to a city's ETJ following an annexation proceeding. Determine the limitations that need to be placed on a city's authority within the ETJ to better protect the private property rights of individuals and landowners, and ways to notify individuals of the impact of being within a city's ETJ. Develop a statewide rule and minimum requirements for such notifications.
6. Housing Affordability: Examine issues that impact housing affordability, including the effect of local government taxes, fees, and mandates. Evaluate the cost of purchasing a single-family residence in different parts of the state, factoring in the impact of local rules and regulations, to identify matters of policy with the greatest influence, and identify ways to increase transparency and awareness prior to the adoption of costly local ordinances or orders.
7. Special Purpose Districts Bond Reform: Study the state agency review of tax exempt bonds issued by special purpose districts and public improvement districts used to finance water and sewer infrastructure in new residential and commercial developments. Examine the disparities that exist between the feasibility review of water and sewer bonds backed by property­ based assessments and those backed by ad valorem taxes, and make recommendations that ensure the continued stability of the Texas tax­ exempt bond market by requiring all districts to undergo appropriate reviews prior to issuance.
8. Municipal Management District Uniformity: In conjunction with the appropriate legislative departments, determine whether the development of a template or standardized language for the creation of municipal management districts would provide a more effective means for legislators to ensure new special purpose districts conform to accepted standards and contain appropriate taxpayer oversight.

6. Pensions: Examine and assess public pension systems in Texas. Specifically, review and assess (1) the different types of retirement plans; (2) the actuarial assumptions used by retirement systems to value their liabilities and the consequences of amending those assumptions; (3) retirement systems' investment practices and performance; and (4) the adequacy of financial disclosures including asset returns and fees. Make recommendations to ensure public pension system retirees' benefits are preserved and protected.
7. Attorney General Jurisdiction: Examine the Attorney General's jurisdiction on issues of alleged violations of state laws regarding abortion and multi -jurisdictional human trafficking cases. Make recommendations to ensure uniform enforcement across the state.
8. Court Fees: Examine the structure of court fees and make recommendations to ensure statutory filing fees and court costs are appropriate and justified. Provide reeommendations for proper agency oversight of fee collection.
9. Campus Free Speech: Ascertain any restrictions on Freedom of Speech rights that Texas students face in expressing their views on campus along with freedoms of the press, religion, and assembly. Recommend policy changes that protect First Amendment rights and enhance the free speech environment on campus.
10. 1. Study and assess the state’s preparedness for public health threats and emergencies including responding to natural disasters and highly infectious diseases. Review current protocols and examine public health resources to determine if they are sufficient. Identify weaknesses within the public health response framework and make recommendations for improvements.
2. Study the impact of chronic disease in Texas and identify the major regional chronic health challenges. Review the types of health data collected by the state related to chronic disease and how the data is utilized to improve health care. Study state programs targeting chronic disease, including the Texas Health Improvement Network, and identify the direct and indirect costs associated with obesity, tobacco, and other related chronic health conditions including impacts to Medicaid, Employees Retirement System, Teacher Retirement System, University of Texas System, and Texas A&M University System. Identify public health interventions for chronic disease and preventative healthcare services that improve health outcomes and reduce cost.
3. Examine the history of telemedicine in Texas and the adequacy of the technological infrastructure for use between Texas healthcare providers. Review the benefits of using telemedicine in rural and underserved areas and current reimbursement practices. Explore opportunities to expand and improve the delivery of healthcare and identify methods to increase awareness by provider groups, including institutions of higher education, and payers of telemedicine activities being reimbursed in Texas.
4. Review programs focused on improving birth outcomes including evaluating the effectiveness and identifying any cost avoidance associated with them. Study barriers pregnant women face enrolling in services and receiving regular prenatal care. Identify factors, including substance abuse, associated with preterm birth and review services available for mothers postpartum.
5. Study the trauma system in the State of Texas including financing, service delivery, planning, and coordination between Emergency Medical Services providers, Trauma Services Area Regional Advisory Councils, The Emergency Medical Task Force, and hospitals. Determine strengths and weaknesses including challenges for rural areas of the state. Make recommendations to reduce any duplicated services, improve the coordination of services, and advance the delivery of trauma services in Texas. 6. Conduct legislative oversight and monitoring of the agencies and programs under the committee's jurisdiction and the implementing of relevant legislation passed by the 84th Legislature. 1. Study if the state's infrastructure is adequately prepared for disasters, whether man-made or natural. Include preparedness assessments of the maintenance and recovery of vital infrastructure such as transportation and utility systems.
2. Examine procedures regarding contract monitoring, compliance, performance evaluation and notification requirements for state contracting procedures. Include recommendations to determine a "best value" for the state and prevent conflicts of interests. Evaluate guidelines regarding the state's participation in contracts funded by grants and suggest methods to ensure the best use of taxpayer funds.
3. Determine if the state has sufficient authority and the tools to ensure continued operation of the state's government and economy under existing budgetary and statutory authority. Make contingency recommendations to prevent collapse in the event of an economic disaster.
4. Study the policies used by research and medical entities to adhere to the highest ethical standards for acquiring human fetal tissue for medical and scientific purposes. Specifically, review compliance to ensure informed consent and that all state and federal laws sufficiently respect the dignity of the human body. Study criteria for which persons have standing when giving consent for the use of fetal remains and to investigate potential violations of state laws regulating organ/tissue donation. Determine whether additional disclosure and reporting requirements are necessary to ensure moral and ethical research practices. Review practices and statutes in other states regarding fetal tissue harvesting.
5. Study support mechanisms for the Small and Rural Incumbent Local Exchange Carrier - Universal Service Fund. Consider alternative funding mechanisms as well as necessary statutory changes to ensure reasonable cost of basic local phone service in high cost, rural areas without expanding the size of the Texas Universal Service Fund.
6. Evaluate the administrative process used to determine utility rates. Consider if sufficient opportunities exist to ensure customer representation. Also determine if additional legislative guidance is needed to ensure public notification and participation.
7. Examine how the Public Utility Commission of Texas, when applicable, and utility providers, whether vertically integrated, privately owned, or municipally owned, can ensure consumer protection regarding metering devices for water, gas, and electricity service. Review recent examples of inaccurate or confusing billings and offer recommendations on appropriate consumer recourse and appeal. In addition, assess utility procedures regarding meter installation.
8. Examine state and local laws applicable to undocumented immigrants throughout the State of Texas and analyze the effects of those laws in conjunction with federal immigration laws and the policies and practices followed by U.S. Immigration and Customs Enforcement.
9. Examine payroll deductions from state or political subdivision employees for the purpose of labor organization membership dues or fees as well as charitable organization and nonprofit contributions. Determine if this process is an appropriate use of public funds.
10. Monitor the impact of major State Affairs legislation passed by the 84th Legislature, including updates regarding recent contracting reforms. Conduct legislative oversight and monitoring of the agencies and programs under the committee's jurisdiction and the implementing of relevant legislation passed by the 84th Legislature. Examine whether changes are needed to the Texas Department of Housing and Community Affairs’s (TDHCA) low-income tax credit program to ensure compliance with the U.S. Supreme Court's decision in Texas Department of Housing and Community Affairs et al. v. Inclusive Communities Project, Inc., et al. on fair housing in Texas.
4. Review existing housing programs and policies in Texas to determine how to best comply with the U.S. Department of Housing and Urban Development's new Affirmatively Furthering Fair Housing Rules.
5. Monitor and evaluate the availability of low-income housing in the State of Texas. Identify best practices to ensure that the agencies and local providers receiving state or federal funds for low-income housing are maximizing the number of units of housing available to Texans who need this program.
6. Investigate the operation and regulation, including a review of standards, monitoring, and enforcement, of boarding homes in municipalities and unincorporated areas of counties. Identify communities that have adopted local standards, and review procedures for investigating and closing unlicensed facilities that are providing services which require state licensure. 1. Upon passage of federal legislation relating to reform of the health care industry and health insurance industry that the Texas Health and Human Services Commission estimates will costs the State of Texas $2 to 2.5 billion per year in General Revenue beginning as early as 2013, study the implications of such legislation on Texas, the health care industry, and public and private insurance. Study and monitor the implementation of the insurance regulatory changes, changes to high risk pool, and any other insurance mandates. Study the health care policy changes and the impact to the Medicaid and CHIP programs and the state budget. Assess the impact to all state uninsured and uncompensated care programs and county programs for the uninsured, including county property tax programs to pay for the uninsured. Make recommendations for the efficient implementation of programs. (Joint charge with Senate State Affairs Committee)
2. Study the benefits, efficiencies and costs, and effectiveness of the social service related prevention and early intervention programs at the health and human services agencies, the juvenile and adult criminal justice agencies and other government agencies that have programs that address mental illness, substance abuse, child abuse and neglect, domestic violence, single-parent families, absentee fathers, early pregnancy, and unemployment. Study other states' prevention programs and efforts to administer these programs through a merged prevention department. Make recommendations to improve the efficiency and effectiveness of these programs.
3. Review the timeliness and efficiency of the Health and Human Service Commission's eligibility system. Include a review of staffing levels and staffing distribution; implementation of Rider 61; and the increased demand on the system. Make recommendations to improve the efficiency and effectiveness of the system, focusing on policy changes that will not create a large financial burden for the state.
4. Study and make recommendations on the state's role for facilitating the exchange of health care information in the future, including using the Medicaid exchange as a framework for the statewide exchange of health information between health care providers to improve quality of care; what information the state should provide; how to use this information to improve care management, prevent medical errors, and reduce unnecessary services; and policies and statutory changes needed to ensure that privacy is protected. Study the feasibility of developing multiple regional health information technology exchanges in Texas.
5. Study the state's current and long-range need for physicians, nurses, dentists and other allied health and long-term care professionals. Provide recommendations for ensuring sufficient numbers of health care professionals, focusing on medically underserved and rural areas of the state as well as the Border region. Consider health care delivered by Advanced Practice Nurses in terms of access, cost and patient safety and include an assessment of independent prescriptive authority with those states in which prescriptive authority is delegated by a physician. Make recommendations to enhance the efficient use of Advanced Practice Nurses in Texas.
6. Explore strategies to support the needs of aging Texans, including best practices in nursing home diversion, expediting access to community services, and programs to assist seniors and their families in navigating the long-term care system with the goal of helping seniors remain in the community. Study the guardianship program implemented by the Department of Aging and Disabilities and the Department of Adult Protective Services, including the efficiency and effectiveness of the program, the relationship between the two agencies, the appropriate rights for parents, and whether clients and their assets are adequately protected to ensure the state is appropriately identifying seniors in need of protection.
7. Examine how the state could enact policies to improve the overall health of Texans, focusing on programs that compliment individually-based prevention with community­based prevention to reduce obesity rates by increasing physical activity, improving nutrition, and improving self-management of chronic diseases such as diabetes. Examine obesity-related health disparities between different ethnic groups and ways to narrow these gaps. Consider the fiscal and health impact of second-hand smoke on businesses and service sector employees. Study state-level initiatives to incorporate these individual and community-based prevention strategies, including initiatives pursued in other states.
8. Study the state's ability to appropriately respond to the H1N1 influenza pandemic by examining issues related to vaccine distribution and capacity. Consider the benefit of providing the state's independent school districts and various health authorities with standardized protocols for issues including, but not limited to, vaccine administration, absenteeism and the cancellation of school and other school-related events. Assess the state's ability to track and record H1N1 vaccinations through the ImmTrac registry, and review statutes governing ImmTrac to increase the effectiveness and efficiency of immunization information systems.
9. Study current state health care quality improvement initiatives in Texas, including statewide health care-associated infection and adverse event reporting, reimbursement reductions in the Texas Medicaid program for preventable adverse events, potentially preventable readmissions identification, health information technology implementation, pay-far-performance programs, and other initiatives aimed at improving the efficiency, safety, and quality of health care in Texas. Identify statutory changes that may build upon efforts to improve quality of care and contain health care costs in Texas. Study policies that encourage and facilitate the use of best practices by health care providers including the best way to report and distribute information on quality of care and the use of best practices to the public and to promote health care provider and payment incentives that will encourage the use of best practices. The study/recommendations could also include assessing the best way to bring provider groups together to increase quality of care, the use of best practices, and reduce unnecessary services.
10. Study current practices of the Texas Medical Board relating to disclosure of complaints.
11. Review the types of human stem cell and human cloning research being conducted, funded, or supported by state agencies, including institutions of higher education. Make recommendations for appropriate data collection and funding protocols.
12. Review the Medicaid HCBS waivers (CBA, STAR Plus, CLASS, MDCP, DBMT, TxHmL) and develop recommendations to assure that people with significant disabilities, regardless of disability label or age, receive needed services to remain in or transition to the community. Review should look at the delivery system, eligibility, service packages, rate structures, workforce issues and funding caps. Examine options for the provision of services for children aging out of the Medicaid system. Make recommendations for streamlining/combining these waivers, ensuring that these waivers are cost effective or create cost savings, and developing policies that contain costs in an effort to increase access to these services. The review should examine other states' community care waivers and provide recommendations relating to efforts that have been successful in other states.
13. Study the type, duration, frequency and effectiveness of mental health services available to and accessed by abused and neglected Texas children. Recommend strategies to address the impact of the trauma, and enhance therapeutic services available to this population in an effort to eliminate the cycle of abuse and neglect.
14. Monitor the implementation of legislation addressed by the Senate Committee on Health & Human Services, 81st Legislature, Regular and Called Sessions, and make recommendations for any legislation needed to improve, enhance, and/or complete implementation.
  • Monitor Department of Family and Protective Services' implementation of the U.S. Fostering Connections Act, including the new Kinship Care program. Include recommendations on how to optimize the use of monetary assistance to qualified relative caregivers.
  • Monitor the Department of Aging and Disability Services (DADS) implementation of SB 643, relating to Texas' state-supported living centers (SSLCs), implementation of Special Provisions relating to All Health and Human Services Agencies, Section 48. Contingency Appropriation for the Reshaping of the System for Providing Services to Individuals with Developmental Disabilities, and implementation of the United States Department of Justice (DOJ) Settlement Agreement terms.

Study the incidence of fraudulent automotive emissions certifications in the state and recommend changes in enforcement which will increase the effectiveness of state emissions regulation and assist in attainment of federal air quality standards.
2. Review and make recommendations relating to the Texas Department of Transportation's organizational structure and working relationship with local governments, Metropolitan Planning Organizations, Regional Tolling Authorities and Regional Mobility Authorities.
3. Recommend improvements to homeland security, including the state's infrastructure and housing recovery operations. 4. Examine the public policy implications of Comprehensive Development Agreements (CDAs) and recommend whether they should be reauthorized to construct specific roadways.
5. Explore the policy implications of transportation reinvestment zones funded by state sales and use taxes as an alternative to public financing of transportation projects.
6. Examine transportation funding concepts contained in legislation considered during the 81st Legislature, Regular and Special Sessions. 4. Study and make recommendations regarding state and local regulation of billboards. Produce a graphical analysis of current billboards, evaluate objective criteria for locations where billboards can be permitted or prohibited, including but not limited to geographical (corridor or urban/rural), land usage (e.g. industrial), or cultural/historical criteria, and include consideration of the impact on any federal funding.
5. Study and make recommendations for improving management and oversight of Metropolitan Planning Organizations (MPOs). Include a review of populations served, MPO governance, oversight, roles, variation among MPOs, and MPO decision-making ability in relation to TxDOT or other agencies.
6. Study Comprehensive Development Agreements (CDAs) and make recommendations to ensure the maximum benefit to taxpayers. Study the implications of requiring CDAs to have definitive buyback formulas that can be calculated without using any form of future revenue forecasts. Study requiring potential CDA projects to be solicited only after environmental clearance has been granted. Study the implications of shortening CDA's maximum allowable contract duration. Study provisions affecting competing facilities.
7. Review the status of structurally deficient bridges and provide increased oversight of TxDOT's bridge repair activities to ensure that any unsafe bridges are identified and repaired as soon as possible.
8. Study and make recommendations relating to the status of current and planned toll road projects in Texas, the use of public-private partnerships to build new roads and/or transit services, and the market valuation process. Analyze the impact of lengthening the number of years a toll road authority may issue bonds.
9. Study the effectiveness of the Trans-Texas Corridor (TTC) and make recommendations for its future role in providing additional roads in Texas. Provide specific recommendations relating to public input in the development of the TTC.
10. Study the impact of prohibitions in Section 2301.476 (Manufacturer or Distributor Ownership, Operation, or Control of Dealership), Occupations Code, on the sale of buses in Texas and make recommendations. Gather information and monitor the methods of sale of buses in other states and the dealership network, if any. Evaluate the need and possible benefits or detriments caused to public and private sector in application of this law and rule to the bus industry.
11. Study the issue and amount of state agency expenditures on media activities and the legal authority for such expenditures. Develop recommendations for guidelines to ensure appropriate use of state funds to provide legitimate public education.
12. Monitor urban crime laboratories and their compliance with state laws regulating their functions and make recommendations to restore public trust in their functions and to ensure full compliance with federal Homeland Security reporting requirements. Specifically, review the report issued by the Independent Investigator for the Houston Police Department Crime Laboratory and Property Room, the independent panel review of certain criminal convictions prompted by the conclusions of this report, and the implementation by the City of Houston of any reforms recommended in this report.

Review current FBI reports on security and verifiability. Consider the implications that acceptance of the card on a state or local level would have on federal immigration policy and homeland security.

1. Oversight functions shall be conducted for all appropriations-related actions of those agencies assigned to this committee for appropriative purposes during the 66th Regular Session of the Legislature. The agencies include: Advisory Commission on Intergovernmental Relations Texas Assessor Examiners State Property Tax Board (School Tax Assessment Practices Board)
2. Review the legal status and effects of validation acts.
3. Review the status of hospital districts in Texas created by general and special law, including processes of petition, election, funding and administration.
4. Review the particular problems encountered by hospital districts which are required to treat large numbers of indigent patients or districts which support medical schools or teaching hospitals. Make recommendations regarding funding for indigent health care and residency programs. *
5. Review county bidding, contracting and purchasing procedures.
6. Determine the costs to counties caused by the district judicial and administrative system of Texas.
7. Study risk management of elected and appointed officials of local government.
8. Study the legal relationships between utility districts and cities' extraterritorial jurisdiction when the two units overlap.
9. Determine the status of reserve deputy sheriffs in Texas with particular attention to the question of employment and compensation for work involving private security.
10. Evaluate the adequacy of the Texas Disaster Act of 1975 to determine if more state effort is needed to assist local governments in disaster relief, cleanup operations, and evacuation planning and machinery.
